  • You may file your renewal application up to six months before your renewal date or up to six months following the expiration of your registration. If you fail to renew your mark, it will be removed from the trademark register, and third parties may potentially use or infringe your brand.

Introduction

After your trademark is registered, it is important to understand that your rights do not remain protected forever without any action. In India, for instance, a registered mark has to be renewed every ten years, per trade marks act (TM Act) provisions, to maintain exclusive rights in respect of the registered mark. 

You may apply to renew the mark, at least six (6) months prior to the end of the period of ten (10) years; or even after the ten (10) year period has ended, if it is within the grace period, upon paying a fee. 

To renew your trade mark simply means you are continuing to keep your rights in respect of that mark, and so you will keep a standing in respect of using, defending, franchising or assigning out your mark, without lapse — this is very important to sort of maintain brand equity, consumer trust and legal stand.

What is Trademark Renewal?

In India, every registered trademark is subject to renewal every ten years to maintain ownership rights and legal protection. Ideally, you should file the renewal at least six months prior to its expiry date to provide for uninterrupted protection and the renewal is completed using Form TM-R with the prescribed government fee of ₹4,000 per class.

Timely renewal of your trademark protects your mark from removal or restoration proceedings under the Trade Marks Act. If renewal is not filed within the prescribed time, your mark may be removed from the register and you will lose exclusive ownership rights. Therefore, renewal is necessary since it provides rights for another ten years and continues to protect your brand’s legal position and commercial status in the market.

Required Documents for Trademark Renewal

To renew a trademark in India, the applicant must compile and present the following documents: 

  • Copy of Trademark Registration Certificate: Proof of ownership of the registered trademark. 
  • Proof of Commercial Use: Documents establishing use of the mark in trade or business. 
  • Trademark Search Report: Verifying that there are no identical or similar trademarks in the registry. 
  • Power of Attorney: Authorizing an agent or representative to file the renewal for the applicant. 
  • Applicant’s Address & ID Proof: Documents of the proprietor or company that are a valid identification and a valid identification of the address. 
  • Copy of Form TM-A: The original application form used for trademark registration. 
  • Proof of Conflict (if any): In the case of any trademark dispute, copies of any documents that relate to the conflict and any legal opinion. 
  • Renewal Application (Form TM-R): Duly filled and signed application for trademark renewal that is prepared in accordance with the prescribed condition.

Procedure for Trademark Renewal in India

The process of renewing a trademark must be done through the Registrar of Trademarks, using Form TM-R, ideally no later than six months in advance of the expiry date of the current registration. A brief overview of the renewal process is detailed here: 

  1. Preparing the Renewal Application 
  • The trademark owner or an agent of the trademark owner must file Form TM-R and pay the notarized renewal fee. 
  • If a renewal application is not filed prior to the expiry date, the trademark owner can renew the trademark between one and three months before the trademark expires without a penalty.
  1. The Registrar Provides Notice
  • The Registrar of Trademarks will send notice regarding the renewal and remind the owner of the expiration date. The expiration cannot be removed from the trademark registry based solely on the absence of this notice.
  1. Payment for Renewal 
  • The renewal fee must be paid along with the TM-R. 
  • This fee renewal protects the trademark legally for another ten (10) years. 
  1. Method of Renewal 
  • A trademark can be filed in two ways:
  • Simple Renewal: Like for like with no changes made to the details or logo.
  • Renewal with Modification: Change to the details, logo or classification, if required.

     

  1. Review and Circulation

The trademark renewal application will be reviewed and published in the Trademark Journal following its approval by the Registrar. The Trademark Journal is the official publication of the Trademark Office. At this stage, any third parties wishing to object or oppose the renewal can do so.

  1. Monitor Status

Once a renewal application is submitted, it is essential for applicants to monitor the status of the renewal application to avoid delays. The trademark renewal process is subject to strict time limits, and the applicant will not operate under the assumption that the renewal application has been granted if he or she has not received a response. Time limits arranged for the renewal process may affect the ability of the applicant to renew if he or she fails to act in a timely manner.

  1. Expiration and Recovery

The proprietor has six months following the date of expiration to renew the trademark; otherwise, the trademark will be considered expired. The proprietor may, however, apply for recovery of the trademark under Section 25(4) of the Trade Marks Act, 1999. A trademark recovery application, along with the prescribed fee, may be submitted to the Registrar within one year after the date of expiration.

This simplified renewal process will ensure that your trademark retains the legal protection to avoid interruption and appropriately protects identity and goodwill in the market place.
