  1. Resolution or Award:

Mediations or conciliations end with a settlement agreement which is signed digitally. Arbitration will lead to a binding award that can be enforced under the Arbitration and Conciliation Act, 1996.

  1. Enforcement:

Settlement agreements can be filed in the court for enforcement if required. Arbitral awards are automatically enforceable in the same manner as court decrees.

  1. Appeal or Review:

If procedural irregularities or bias are shown, parties can appeal or seek judicial review. Arbitration has limited grounds for challenge.

Legal Framework for Online Dispute Resolution in India

Arbitration and Conciliation Act, 1996

 This Act lays the groundwork for resolving disputes through the alternative methods of mediation, conciliation, and arbitration, without recourse to conventional courts.
