E-waste management is the responsible collection, recycling, reuse, and disposal of electronic waste in an environmentally sound manner. The aim here is to preclude any threat posed by e-waste to the environment and humans. In other words, e-waste management is vital because improper management poses tremendous threats at times when there is little knowledge from the public. The very existence of e-waste deserves important considerations of better recycling and management.

One of the important control measures in reducing  material generation in the future is careful management of all materials used up during manufacture, especially toxic ones and excess raw material inventories. These two can be implemented in the following manner:

  • Procedures for Approved Purchases of Materials: Set procedures for strict scrutiny of material purchase for production.
  • An Inventory Tracking System: Set up systems for proper tracking of raw material inventory levels and usage.

  • Legality: E-waste legislation becomes a hammer to manufacturers, importers, and producers of electronic goods. 

Extended Producer Responsibility (EPR): An Understanding

Extended Producer Responsibility (EPR) moves the responsibility to producers themselves with regards to the management of e-products. That is the manufacturers, importers, and brand holders are to be held liable to conduct all activities relating to e-waste arising from their products, like collection, transport, recycling, and disposal.

  • Returns are to be submitted quarterly and annually on the portal within the month following the reporting period.

III. Refurbishment

  • Registration in the designated portal.
  • Compliance of refurbished equipment with standards in force.
  • Returns to be submitted quarterly and annually on the portal within the month following the reporting period.
  1. Bulk Consumer
  • E-waste should be handed over only to registered producers, refurbishers, or recyclers.
  1. Recyclers
  • Registration in the designated portal.
  • Implementation of standards and processes for facilities and recycling set by the Central Pollution Control Board (CPCB).
  • EPR obligations of producers/manufacturers.
  • Recording all operations pertaining to e-waste in the portal and making the information available for verification when asked.
  • Other non-mentioned e-wastes may also be accepted for recycling, unless it is radioactive, for which processing will be reported on the portal.

E-Waste (Management) Rules, 2022 With EPR

The E-Waste (Management) Rules 2022 were brought into force on November 2, 2022, by the Ministry of Environment, Forests, and Climate Change, with effect from April 1, 2023. These rules stipulate that the manufacturers, producers, refurbishers, and recyclers manage their generated e-waste by registering on a designated portal for its recycling or disposal. 

Thus, entities would be required to register on the portal under the proper category, and the ones involved in multiple categories should register separately for each. No unregistered entity can carry on its business. All registered entities have to make an annual and quarterly return in the prescribed format, within the month succeeding the relevant period through the portal.

These regulations will apply to each stakeholder involved in the e-waste and electrical/electronic equipment lifecycle mentioned in Schedule I, including manufacturing, selling, refurbishing, dismantling, recycling, and processing. Producers of electrical and electronic equipment mentioned in Schedule I shall register into the portal for the establishment and implementation of the extended producer’s responsibility targets assigned in Schedules III and IV. The producers who already initiated the EPR plan under the E-Waste (Management) Rules, 2016, must proceed with the EPR under a procedure to be laid down by the CPCB and approved by the Steering Committee.

Extended Producer Responsibility Application Process:

Below are detailed procedure steps for the Extended Producer Responsibility (EPR) authorization or registration:

  • Documentation: Gather the necessary documents for applying for EPR authorization, including a detailed EPR plan.
  • Application Form Submission: Complete the application form appropriately and accurately with a description of the EPR plan and other details.
  • Application Submission: Submit the duly filled application form with all supporting documents to the respective department offline.
  • Application Review: CPCB (Central Pollution Control Board) reviews the application and evaluates the EPR Plan. In case of any missing or not clear information, the CPCB may issue a checklist requesting clarifications within maximum 25 days.
  • EPR Authorization Approval: The EPR plan gets approved by the Chairman, CPCB, after the evaluation. The divisional head issues the EPR authorization after approval.
