What is the Extended Producer Responsibility (EPR)?

The growing challenges have seen the Government of India introduce the Extended Producer Responsibility (EPR) framework under the Plastic Waste Management (PWM) Rules of 2016. EPR holds the responsibility of managing plastic waste to the Producers, Importers, and Brand Owners (PIBOs). These will be responsible for the collection, recycling, reusing, or safe disposal of plastic packaging waste from the products they put in the market.

In India, effective July 1, 2022, the manufacture, import, stocking, sale, distribution, and use of a few specified single-use plastic (SUP) items have been banned under the Plastic Waste Management (Amendment) Rules, 2021.

Legal Framework & Amendments

February 16, 2022, the Ministry of Environment, Forests, and Climate Change published an amendment of the PWM Rules in which PIBOs and Plastic Waste Processors (PWPs) are liable to perform their responsibilities under the provisions of Schedule II of the amended rules.

EPR Registration Process

Now, under these guidelines:

PIBOs need to register on the Centralized Online EPR Portal developed by the CPCB.

PIBOs operating for one or two states/UTs need to register with the State Pollution Control Board (SPCB) or Pollution Control Committee (PCC) accordingly.

In case PIBOs operate in more than two states/UTs, they need to register with CPCB.

Compliance and Certification

For compliance with the EPR target, the two-fold actions that the PIBOs need to take will include:

Engaging authorized Plastic Waste Processors (PWPs).

Ensuring the waste management is done according to the EPR Action Plan.

PWPs will issue certificates based on the amount of plastic waste processed. PIBOs can use these certificates to demonstrate compliance with the target.

Failure to comply may result in the imposition of environmental compensation and those prescribed by law or through any regulatory measures.

Plastic Packaging Categories Subjected to Extended Producer Responsibility (EPR)

According to the Plastic Waste Management Rules, the EPR framework categorizes plastic packaging into four heads. The following distinct categories reiterate the responsibilities of Producers, Importers, and Brand Owners (PIBOs) under plastic waste management:

Category I: Rigid Plastic Packaging

This includes any type of rigid or hard plastic packaging that retains its shape and presents a very limited scope of deformation.

Category II: Flexible Plastic Packaging

This would include:

Flexible plastic packaging that is single- or multi-layered (with different types of plastic layers)

Plastic sheet or sheet-like materials

Plastic covers, carry bags, sachets, and pouches

Category III: Multi-Layered Plastic Packaging

Packaging materials composed of:

At least one layer of plastic and

At least one layer of a material other than plastic (including aluminum, paper, etc.).

Category IV: Compostable Plastic and Plastic Sheets

Including:

Plastic sheets or sheet-like packaging materials

Certified compostable plastic carry bags

Procedure for Plastic Waste Compliance

  • Application submission : The online application form for authorization of plastic waste management and all requisite documents have to be submitted by the applicant via the official designated portal.
  • Application Verification: The concerned SPCB or UTPCC shall verify and inspect the submitted application.
  • Document Examination: The documents submitted will be examined.
  • Decision About an Authorization: After that, the SPCB or UTPCC shall either approve or refuse the application for authorization for plastic waste management.

EPR registration : validity Renewal, and Cancellation Procedure

The original registration is for one year, while the renewed registration is for three years.

PIBOs will be able to submit applications for renewal with all required documents four months before the expiry date of registration.

The registration granted to PIBOs under EPR Plastic Waste can be cancelled or suspended at any time if false documents are discovered.
