Introduction

A few years ago, a small NGO from Uttarakhand contacted Diligence Certifications for help—not seeking a license for business or a compliance certificate, but larger assistance. They had uncovered poor, untreated, uncontrolled industrial waste going into the local river—polluting the water for thousands of people. They didn’t have the resources for a corporate lawsuit, but they had the will to fight for their community.

Our team guided them to file a Public Interest Litigation (PIL) action in the High Court. Within months, the High Court ordered the polluter to shut down, and directed the government to conduct inspections on that factory and others in the area regularly. This is the power of PIL in India—ordinary people making extraordinary legal change.

What is Public Interest Litigation (PIL)?

Public Interest Litigation is an action that allows anyone—not only the directly affected party or parties—to approach the court on behalf of the public on a matter of public interest, especially to protect people’s fundamental rights afforded to them under Part III of the Indian Constitution

The concept of public interest litigation has evolved as a legal remedy in the Constitution. The plaintiff (party complaining in the action) is not required to have any direct personal interest in the case. If it affects the public good a case can be brought, even if the issue is in the nature of environmental damage, corruption, or human rights violation.

What are the Documents Required for Filing Public Interest Litigation in India?

The following documents will usually need to be filed with a PIL:

  1. Petition Draft- A short statement of the material facts, relief requested, and legal provisions invoked.
  2. Affidavit- A sworn statement that the material facts in the petition are true.
  3. Supporting Evidence – Supporting evidence to substantiate the petition as photographs, videos, government records, examination of experts or replies to an RTI.
  4. Identity Proof of Petitioner – Aadhaar card, Voter ID or passport.
  5. Court Fees- Typically a nominal amount (around ₹50 in the Supreme Court; variable in High Courts).
  6. Vakalatnama – In cases where the petitioner is represented by a lawyer.

What is the History of Public Interest Litigation in India?

PIL is a relatively recent judicial innovation in India:

  • 1970s-1980s: The term was coined for the first time by Justice P.N. Bhagwati and Justice V.R. Krishna Iyer, contemplating the idea in the Supreme Court. 
  • Hussainara Khatoon vs. State of Bihar (1979): This actual case will be seen as the beginning of the PIL movement; the first PIL in India, has a narrow reference to undertrial prisoners and their rights. 
  • Evolution: PIL was for human rights, and then evolved to incorporate environmental protections, consumer rights, corruption, governance .

Process of Filing a PIL in India
