Mutual Divorce: Process, Requirements, and Legal Aspects

  • Mutual divorce in India is a legal procedure in which both partners voluntarily agree to separate their marriage. In India, mutual divorce falls either under the Hindu Marriage Act of 1955, or the Special Marriage Act of 1954. 
  • In order for parties to complete the mutual divorce process, spouses are required a one-year separation period, they have to file a joint petition, and they must get through Part 1 of section 13B in order for the final decree to be granted by the court.
  • The key decisions that need to be made—alimony, custody of children, division of property—need to be decided upon mutually before issuance of the application.
  • The mutual divorce consists of two motions, and there is a six month cooling-off period (which can be waived in some limited situations).
