Key takeaways
- A logo is registered as a device mark (trademark) under the Trade Marks Act, 1999, not as a separate “logo law”.
- Applications are filed online with the Trade Marks Registry through the IP India portal, under the Controller General of Patents, Designs and Trade Marks (CGPDTM).
- Goods and services are grouped into 45 classes (the NICE Classification); you register your logo in the classes relevant to your business.
- Once filed, you can use the ™ symbol immediately; the ® symbol may be used only after registration.
- A registered logo is valid for 10 years and is renewable indefinitely in 10-year blocks.
- Lower government fees apply to individuals, startups, MSMEs and sole proprietors who file on Form TM-A.
What is logo registration?
Logo registration is the process of protecting your brand’s visual identity by registering it as a trademark in India. In law a logo is treated as a device mark - a graphic, symbol, monogram or stylised wordmark - and is registered under the Trade Marks Act, 1999 and the Trade Marks Rules, 2017.
A registered logo gives you the exclusive right to use that mark for the goods or services it covers, and a legal basis to stop others from copying or imitating it. It turns your brand from an informal asset into intellectual property you can defend, licence and even sell.
What you can register as a logo
- A pure graphic, symbol or emblem
- A stylised wordmark or brand name in a distinctive font
- A combined mark: text and device together
- A monogram, initials or signature
- A logo incorporating a tagline or slogan
- A logo in colour, where colour is a feature of the mark
Where a logo fits among trademarks
A logo is one type of trademark. Knowing how it relates to a wordmark helps you decide what to protect first - many brands register both.
| Type of mark | What it protects |
|---|---|
| Device / logo mark | The specific visual design, symbol or stylised graphic. |
| Word mark | The brand name as text, in any font or styling. |
| Combined mark | Logo and name registered together as a single unit. |
| Consideration | Why it matters |
|---|---|
| Scope of protection | A wordmark protects the name in all styles; a logo protects the exact design. |
| Best practice | Register the name and logo separately for the widest cover. |
| Class selection | Protection applies only to the classes you file in. |

Who should register a logo
Anyone using a logo in trade can apply - you do not need to be a registered company. Registration is especially important for:
Startups & founders
Lock down your brand identity early, before a competitor or copycat does.
Retailers & D2C brands
Most marketplaces and brand-registry programmes require a registered logo.
Manufacturers
Protect product branding and packaging across your full range.
Professionals & firms
Secure a service identity for clinics, consultancies and agencies.
Restaurants & franchises
A registered logo is essential before licensing or franchising a brand.
Exporters
An Indian registration is the foundation for protecting your mark abroad.
The registration process, step by step
The entire process runs online through the IP India portal. Timelines depend on the Registry’s workload and whether any objections or oppositions arise.
Search & filing
Trademark search
We run a public-search check on the IP India database to confirm your logo is distinctive and available in the relevant classes.
Select classes
We map your goods and services to the correct NICE classes so your protection matches your business.
File Form TM-A
The application is filed online with the logo artwork, applicant details and class list, and the government fee is paid.
Use the ™ symbol
Once the application number is generated, you can start using the ™ symbol on your logo.
Examination to registration
Examination
The Registry examines the application and may raise an examination report (objection) under the Act.
Reply & hearing
We draft and file a reply to any objection, and attend a hearing before the examiner if required.
Journal publication
The mark is advertised in the Trade Marks Journal, opening a four-month window for third-party opposition.
Registration
If unopposed (or after opposition is decided in your favour), the certificate is issued and you may use the ® symbol.
Documents required
- A clear copy of the logo artwork (JPEG, as used or intended to be used)
- Applicant’s name, address and nature of business
- Identity and address proof of the applicant or signatory
- Signed authorisation on Form TM-48 (Power of Attorney) for us to act on your behalf
- Udyam (MSME) or DPIIT startup recognition certificate, to claim the reduced fee where eligible
- Incorporation or partnership documents, for companies, LLPs and firms
- Date of first use of the logo, with proof, if it is already in use
Validity & renewal
- A registered logo is valid for 10 years from the date of application.
- It can be renewed indefinitely in successive 10-year terms on Form TM-R.
- Renewal can be filed within six months before expiry, or within the grace period with a surcharge.
- A lapsed registration may be restored within the period allowed under the Rules.

Government fees & cost factors
The official fee is charged per class, per application, and depends on who is applying. Reduced fees apply to individuals, startups, sole proprietors and MSMEs; the standard fee applies to other entities. Our professional fee is quoted separately.
| Cost factor | Details |
|---|---|
| Government fee - concessional | Lower per-class fee on Form TM-A (e-filing) for individuals, startups, sole proprietors and MSMEs. |
| Government fee - standard | Higher per-class fee on Form TM-A (e-filing) for companies and other entities. |
| Number of classes | Fees multiply with each additional class you file in. |
| Objection / opposition handling | Additional work where an examination report or third-party opposition is raised. |
| Renewal fee | Payable every 10 years on Form TM-R to keep the registration in force. |

Common reasons logos get objected
Many delays come from avoidable issues at filing. Knowing what the Registry looks for helps your application sail through examination.
- Lack of distinctiveness: a logo that is too generic or merely descriptive of the goods.
- Similarity to existing marks: resemblance to a logo already on the Register in the same class.
- Wrong class selection: filing in classes that do not cover your actual goods or services.
- Prohibited matter: use of official emblems, deceptive elements or content barred under the Act.
- Poor artwork: a blurred or inconsistent logo image that does not match later use.

Frequently asked questions
Is logo registration different from trademark registration?
No. In India a logo is registered as a trademark - specifically a device mark - under the Trade Marks Act, 1999. “Logo registration” simply refers to trademarking your visual brand identity rather than the brand name as plain text.
Should I register my logo and brand name separately?
For the widest protection, yes. A wordmark protects the name in any style, while a logo protects the exact design. Registering both, or a combined mark plus a separate wordmark, gives the strongest cover. We can advise on the best mix for your budget.
How long does logo registration take?
You receive an application number within days of filing and can use the ™ symbol straight away. Full registration usually takes several months to around a year or more, depending on the Registry’s workload and whether any objection or opposition arises.
How long is a registered logo valid?
A registered logo is valid for 10 years from the date of application and can be renewed indefinitely in further 10-year terms by filing Form TM-R before expiry.
Can an individual or sole proprietor register a logo?
Yes. Any person or entity using or intending to use a logo in trade can apply - including individuals, sole proprietors, partnerships, LLPs and companies. Individuals, startups and MSMEs also qualify for a reduced government fee.
What is the difference between the ™ and ® symbols?
The ™ symbol can be used as soon as you file the application, to show you are claiming rights in the logo. The ® symbol may be used only once the logo is officially registered and the certificate is issued.
