Pipeline Approval Process in India: PESO Requirements, Documents & Steps

  • The Pipeline Approval Process in India requires prior regulatory approval for the route, design, construction and working of petroleum pipelines under the applicable safety framework.
  • For petroleum pipelines covered by the Petroleum Rules, 2002, PESO reviews technical drawings, route details, design calculations, testing arrangements and safety provisions before approval.
  • Depending on the pipeline and product, additional requirements from PNGRB, environmental authorities, land-owning agencies and other competent authorities may also apply.

Introduction

Some months back, there was an industrial project which sought guidance from the compliance team while the pipeline engineering of the project was almost complete. The route had been identified, procurement process had begun and civil work was under way. The situation seemed simple in that the project engineers had assumed that regulatory approval could follow engineering.

However, when it comes to pipelines carrying petroleum, such an assumption could be quite costly.

Pipeline approval process does not only involve submission of drawings to the government agency in question. Such factors as route identification, right-of-way, design basis, petroleum type, pressure conditions, construction methods, testing processes, safety systems and operation processes should all tally.

According to the Petroleum Rules, 2002, no petroleum pipeline subject to the provisions of Part V shall be laid except upon prior written approval of the Chief Controller for route, design, construction and working. Moreover, the applicant must submit a project report covering drawings, calculations, codes, construction and testing information, route information, petroleum classification and maintenance arrangements.

Therefore, the best strategy is to deal with the approval issues during the design process and not after making construction decisions.


What Is the Pipeline Approval Process in India?

PESO ( Petroleum and Explosives Safety Organisation) is the regulation process that assesses whether the proposed pipeline route, design, method of construction and operation meet the necessary safety standards.

With regards to the petroleum pipelines covered under Petroleum Rules, 2002, the responsibility of PESO in respect of approval of design and route of pipelines transporting petroleum is described as a Head Office responsibility. This is evident from the present day SOP of PESO, where “Approval / alteration of design route of pipelines transporting petroleum” is one of the approvals undertaken at Head Office level.

This process typically entails:

  1. Identifying the applicable regulatory framework.
  2. Preparing the pipeline project report and engineering documents.
  3. Finalising the proposed route and right-of-way information.
  4. Preparing design calculations and technical drawings.
  5. Submitting the application and prescribed documents.
  6. Regulatory scrutiny and clarification, where required.
  7. Construction and testing in accordance with approved arrangements.
  8. Inspection and submission of as-built documentation.
  9. Commissioning permission or applicable final regulatory clearance.

The exact requirements can change according to the product, pipeline type, location, route and applicable regulations.


Which Authority Approves Petroleum Pipelines in India?

The Petroleum and Explosives Safety Organisation or the PESO is the main safety organisation concerned with the approval of petroleum pipelines within its ambit, as per the Petroleum Rules, 2002.

The organisation claims that its role with respect to the Petroleum Rules includes transport of petroleum through pipeline and inspection of premises with regard to safety considerations.

However, an important aspect which is frequently ignored is that PESO approval and PNGRB approval are not essentially the same approval.

This is because PNGRB provides rules for authorisation and technical aspects relating to natural gas pipelines and petroleum and petroleum products pipelines. Currently, PNGRB has different regulations for authorisation, technical & safety standards and integrity management for petroleum product pipelines.

Thus, it is better to identify each type of approval at the beginning of any project.


When Is PESO Pipeline Approval Required?

Approval under PESO takes on special significance when the pipeline is being used to transport petroleum under the Petroleum Rules, 2002.

Section V of the Petroleum Rules relates specifically to transport through pipelines. Rule 87 covers the definition of scope, and Rule 89 requires written prior approval for the route, design, construction, and operation of the pipeline.

The project should first determine its applicability before freezing engineering.

This is especially true for:

  • Cross-country petroleum pipelines
  • Petroleum product transfer pipelines
  • Pipelines connecting terminals
  • Pipelines connecting storage facilities
  • Industrial petroleum transfer systems where the applicable rules require approval
  • Pipelines associated with petroleum installations
  • Alterations to an already approved petroleum pipeline

The applicability should be determined from the actual product, pipeline configuration, location and regulatory framework rather than from the pipeline’s name alone.


Pipeline Approval Process: Step-by-Step

Step 1: Identify the Product and Regulatory Scope

The first question to ask is “What kind of substance will the pipeline contain?” rather than asking “What kind of application do we need to file?”

Petrol, diesel, crude oil, other petroleum products, and natural gas might each be subject to different laws. PNGRB laws might apply in the case of a natural gas pipeline, whereas laws related to Petroleum Rules and PESO might apply for a petroleum pipeline.

Step 2: Finalise the Pipeline Route

Route planning is one of the most sensitive parts of the Pipeline Approval Process.

It is incumbent upon the applicant to prove the alignment of the line, as well as ensure that the land, easements, and right-of-way necessary are available. Rule 88 under the Petroleum Rules stipulates that the pipeline and all associated facilities may not be constructed without acquiring the necessary land, easements and rights to enable construction and access to inspect, maintain, repair, replace, and patrol the facility.

This means that the route map must not be regarded as a mere map of location It must clearly indicate the alignment, crossing points, terminals, stations, valves, and other significant elements.

Step 3: Prepare the Comprehensive Project Report

The project report forms the technical backbone of the application.

PESO’s Petroleum Rules require a comprehensive project report accompanied by necessary drawings and calculations, including references to recognised codes followed for the design and construction. The report must also provide information about testing, route, petroleum class and provisions for maintenance and patrolling A strong project report should explain the engineering logic of the project rather than merely reproduce design data.

Step 4: Prepare Engineering Drawings and Calculations

The technical package may include:

  • Pipeline alignment drawings
  • Route maps
  • Pipeline profile drawings
  • Piping and instrumentation diagrams
  • Station layouts
  • Valve locations
  • Crossing details
  • Design calculations
  • Wall thickness calculations
  • Pressure calculations
  • Corrosion protection methodology
  • Safety system details
  • Testing procedures
  • Emergency arrangements

One practical issue seen in regulatory applications is inconsistency between different drawings. For example, the valve location shown on the route drawing may differ from the P&ID, or the pipeline length may differ between the project report and as-built documents.

Such inconsistencies are avoidable if the engineering document set is reviewed as one package.

Step 5: Select and Reference Applicable Codes

A pipeline is not approved merely because it has been designed by an experienced engineering team The project should clearly identify the recognised technical codes and standards followed for design, materials, fabrication, testing and operation.
