  • CE Certification India enables Indian producers and exporters to prove that their products subject to relevant EU legislation are in compliance with the prescribed health and safety requirements and environmental protection regulations.
  • The CE mark is not a unique certificate that is issued by the EU central authority. The producer should first select the relevant EU legislation, conduct a necessary conformity assessment and compile technical documentation and the EU Declaration of Conformity.
  • Conformity assessment can be carried out independently by the producer or it might involve participation of the relevant EU Notified Body.

Introduction

A manufacturing company in Ahmedabad designs a novel electrical control unit. A firm in Pune manufactures industrial machinery A start-up from Bengaluru has developed the prototype and is now ready to ship its first consignment to Europe.

The products are ready. The packaging is ready. The potential buyer is keen.

And then comes a single query from the buyer in Europe: “Is the product CE certified?”

It is at this stage that Indian manufacturers realize that the CE mark does not simply mean printing a label on a product box.

CE Marking in India means understanding what the product requirements are according to the European Union laws and showing compliance via the right assessment process. The specific process will depend on the product, the EU regulation applicable to it, the standard used and whether a Notified Body needs to be involved.

According to the European Commission, CE marking is necessary for products covered by certain EU harmonization laws which require this marking. It is not allowed for other products even if the manufacturer wishes to show product quality or safety.


What Is CE Certification?

CE is an abbreviation which means Conformité Européenne, and it may also be called as European Conformity.

It is a sign of manufacturer’s responsibility to demonstrate that the product meets the required standards set out by the EU for its marketing.

According to the European Commission, CE marking enables covered products to enter the market within the EU, provided the requirements have been met.

However, there is a problem with the terminology - “CE certificate”.

There is no unified body in the EU which would issue a universal CE certificate for all products. The manufacturer should:

  1. Identify the EU legislation applicable to the product.
  2. Determine the conformity assessment procedure.
  3. Apply relevant harmonised standards where appropriate.
  4. Conduct required testing and assessment.
  5. Prepare technical documentation.
  6. Prepare and sign the EU Declaration of Conformity.
  7. Affix the CE marking where legally required.

The European Union’s official guidance specifically confirms that there is no central EU body granting permission or issuing one universal certificate for CE marking.


Is CE Certification Mandatory for Products Made in India?

CE Marking requirements depend on the product itself as well as the market in which it is being sold; not just the country where it was manufactured.

As a result, an Indian exporter could be required to use CE marking when selling a product within the scope of relevant EU legislation to the EU/EEA market.

If an Indian company has a good industrial product that is popular in India and receives orders from Germany, then while it shows conformity to Indian regulations, it will not necessarily show compliance to EU regulations.

In such case, the European buyer may demand:

  • Product specifications
  • Applicable harmonised standards

Which Products Require CE Marking?

The answer depends on the applicable EU legislation.

Electrical and Electronic Goods

Electrical appliances might fall under certain legislations like the Low Voltage Directive and Electromagnetic Compatibility Directive.

For instance, a manufacturer selling some types of electrical appliances in other countries might need to prove electrical safety and electromagnetical compatibility.

The respective legislation would also require an EU Declaration of Conformity.

Machinery

Some industrial machinery and related products might be covered by the EU machinery regulations.

Manufacturers should consider all requirements and the conformity assessment procedure prior to selling the machinery in the EU market.

Step 1: Determine the Product

The first step is to identify the product in detail, including its name and model, purpose, specifications, source of energy, materials used, and other aspects. It is very important to have the correct categorization as incorrect identification may result in the incorrect pathway.

Step 2: Determine the Relevant EU Legislation

Identify the EU legislation that pertains to your product. In many cases, a product will need to comply with several pieces of legislation, such as electrical equipment, EMC, or machinery directives.

Step 3: Determine Harmonised Standards

Choose the appropriate harmonised European standards that apply to the product. The standards must be related to its design, intended purpose and legislation.

Step 4: Risk Assessment

Determine possible risks that exist in relation to the product and how these risks can be mitigated through design, protection, components, software, warnings and instructions. Risk assessment is one of the important elements of technical documentation for many products.

Step 5: Test the Product

Carry out all the necessary tests according to the legislation and standards. These tests may include electrical safety, EMC, radio, mechanical, thermal or environmental testing, depending on the type of product. All CE-marked products do not have the same tests.


When Is a Notified Body Required?

This is another point that is often poorly understood with regard to the CE certification of India.

The Notified Body is the organization appointed by an EU member state to carry out conformity assessment for certain products and procedures.
