What Is a Consumer Complaint?

A Consumer Complaint is a written grievance by a buyer or user (for personal use) seeking redress for defective goods or deficient services. It’s legally recognized under the Consumer Protection Act, 2019. This includes physical goods, online purchases, digital services, and even misleading ads.

The complaint must clearly state facts: purchase date, name of seller / manufacturer, defect description, evidence, and what remedy you demand (refund, replacement, compensation). Only written complaints are valid in forum proceedings.

Who is a Consumer?

A consumer is an individual who uses products or services for personal use (not business or resale). A consumer is any person who pays, either fully, partly, or in installments, for a product or service. The person making a purchase can also be considered a consumer if they are purchasing a product or service after being guided and influenced by an advertisement, marketing, or promotion.

A Consumer complaint can be filed according to the worth of the goods or services and the amount of compensation requested. Depending on the amount you are claiming, you would file the claim in the District, State or National Consumer Forum. If the item or service you have purchased online, check the seller’s terms of service for the correct jurisdiction.

 E‑commerce Disputes 

Wrong item, no delivery, no refund, fake listings—especially relevant under Section 94 of the Act.

Misleading Advertisement Complaints 

Weight‑loss mania, miracle cures, with celebrity endorsements; if ads mislead, you have a cause.

Financial & Banking Complaints 

Ledger discrepancies, surprise fees, delays in EMI refunds.

Digital Services, OTT, Coaching Complaints 

Bad content, no refund, non‑delivery of promised value.

Different types may require different approach: e‑commerce claims often need order ID and seller contact; service complaints demand network logs or call‐centre references; financial complaints require bank statements.

Documents Required to File a Consumer Complaint

To file a Consumer Complaint in India, have these documents ready:

  • Complaints application and index
  • Vakalatnama/Letter of Authority (if filed by someone else)
  • Delay condonation application (if filed)
  • Photocopies of relevant documents ( bills, emails and warranties)
  • Copy of notice served on seller/service provider
  • Multiple copies of complaint (5, plus one for each opposite party)

Under the Consumer Protection Act, complaints can be made by:

  • Individuals who purchase goods/services for their own use
  • Legal heir, relative or guardian of a consumer
  • Registered consumer organisations
  • Group of consumers with similar interests

How to File a Consumer Complaint Online?

You can submit your consumer complaint online through the online consumer forum, consumerhelpline.gov.in.

Process to follow:

  • Register as a new user on the portal
  • Log in with your credentials.
  • Click on “File Complaint.”
  • Select type of complaint – product/service.
  • Fill in the details and submit your grievance.

This platform is part of the Government Consumers Grievance Redressal system and ensures timely resolution under the Consumer Protection Act.

Step 1: Provide Written Notice

Before lodging a Consumer Complaint, you must send a written notice to the seller or service provider, laying out the details of the problem and why you are unhappy. If your claim is for more than ₹10,000, we suggest contacting a lawyer and sending the notice on letterhead to convey seriousness.

Step 2: Wait for a Response

The company may respond to your notice with a solution or some compensation. If they do not respond within 15 days (or the response leaves you unsatisfied), you have a full right to go to the online consumer forum under the Consumer Protection Act. 

You can file a complaint online for a consumer complaint through the official grievance redressal system to secure a time-bound legal remedy.

Choose the Right Consumer Forum

According to the Consumer Protection Act, you have to choose the appropriate forum (District, State, or National Commission) according to your value of claim. You have the option to either file the Consumer Complaint yourself or hire a lawyer.

Draft a Written Consumer Complaint

Each online consumer forum has a prescribed form that you will have to follow. You should have attached all relevant documents to your complaint (bills, emails, delivery proof, and the legal notice to the seller).
