The Standards of Weights and Measures Act was incorporated into an act of Parliament in India during December 1956 but actually came into effect from October 1, 1985.

  • Legal Metrology (Approval of Models) Rules, 2011: These rules lay down the criteria for pre-packaged products in the presenting of their information.

  •  Legal Metrology (Numeration) Rules, 2011: Rules are stipulated for writing and use of numbers in legal metrology contexts.

Legal Metrology Online Registration

It is mandatory under Legal Metrology for everyone engaged in any activity concerning weighing and measuring instruments to register. Registration can happen in three capacities:

  • Company Registration: A company or enterprise, which manufactures, imports or packs weighing and measuring instruments, is required to register under legal metrology.
  • Registration of Importer: The Certificate of Registration of Importer is necessary to export or sell weighing and measuring instruments in the Indian market. These could be as a general importer, as an importer/packer (packaging/warehouse registration), or registration of a company under legal metrology Certification. Only standard packed commodities are permitted for importation.
  • Registration for Manufacturer, Importer, Packers: Packaging and Warehouses have been described according to Legal Metrology Certification requirements concerning packaging and warehouse registration for ca. Companies marketing goods in India which require weight and measurement information to be made available on the product’s labeling.

For weight-and-measure-related products like Weighing Machines, the Legal Metrology (LM) department prescribes five stages of registration:

In general, businesses involved in production, import, export, distribution, or sales in packaged goods must comply with legal metrology regulations and the law on packaged commodities.

License Registration Under the Legal Metrology Act

Step 1: Application Submission

Begin with your formal application submitting to the Legal Metrology District office located in that particular state for the license of Legal Metrology-authorized services. Ensure your application is complete and accurate so that there will be no delays or rejection.

Step 2: Document Submission

Submit all required supporting documents for your legal metrology license application. Ensure these documents are accurate, up-to-date, and submitted in the correct format.

Step 3: Payment of Fees

Step 4: Application Review

Exceptions to LMPC Rules

India’s Legal Metrology Packaged Commodities Rules (LMPC Rules) exempt certain pre-packaged goods from obtaining a Legal Metrology Certification for import license. The conditions for exemption include:

  • The net weight of any product is less than ten grams.
  • The minimum dimension of each product is 10 millimeters.
  • The product is fast food packed by hotels/restaurants.
  • The product is a formulation covered under the Drugs (Price Control) Order, 1995.
  • The product is a packaged agricultural commodity exceeding fifty kilograms.

These exceptions fall under Chapter 2 of the Legal Metrology Act that manages packaged products for retail sale.

Listed below are the exclusions from Chapter 2 of the Act:

  • Packages of more than 25 kg or 25 litres, with the exception of cement and fertilizer sold in bags up to 50 kg.
  • Packages meant for industrial use (e.g., products directly shipped from the manufacturer to be used in industries like railways, hotels, or health care).
