Certificates of Legal Metrology are issued by the Ministry of Consumer Affairs, Food & Public Distribution. The key provisions from the amendments have been highlighted below:

  1. An amendment has been made to introduce a new definition of β€œPre-Packaged Commodity.”
  2. β€œPre-Packaged Commodity” refers to a product that is placed in a package, whether sealed or not, without the purchaser being present, and has a predetermined quantity.
  3. It is prohibited to declare different Maximum Retail Prices for similar pre-packaged commodities.
  4. Imported products must mandatorily declare the name of the country of origin, manufacturer, or assembly.
  5. The label of a product should include the name and address of the company, accompanied by qualifying words such as β€œmanufactured by” or β€œpacked by.”
  6. The package must mention the common or generic names of the commodity.
  7. If a package contains a commodity that may become unfit for human consumption after a certain period, the label should include the β€œbest before” or β€œuse by” date, indicating the month and year.
  8. Declarations required on food products have been aligned with the labeling requirements under the Food and Standards Act, 2006.
  9. The provisions of the Drugs and Cosmetics Rules, 1945, apply to packages containing cosmetic products.
  10. Packages containing commodities with a shelf-life should bear the label β€œBest before” or β€œuse by” date, including the month and year.
  11. The retail sale price of the package should clearly indicate the Maximum Retail Price, inclusive of all taxes. The price in rupees and paise should be rounded off to the nearest rupee or 50 paise.

    The provisions mentioned above under the Legal Metrology Packaged Commodities Rules, 2011, do not apply to the following commodities:
  12. Packaged commodities with a quantity exceeding 25 kilograms or 25 liters.
  13. Packaged commodities intended for institutional or industrial consumers.
  14. Fertilizers, cement, and agricultural farm produce sold in bags weighing more than 50 kilograms.
